Terms of service

1. Acceptance

By creating an account and using Compliantly, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the service.

2. The service

Compliantly is a software-as-a-service platform that helps you build and operate an ISO 9001:2015 quality management system. We provide document templates, registers, workflows, AI-assisted drafts, audit readiness tooling, and reporting.

What we are NOT: a certifying body, a legal advisor, a regulatory authority, or a substitute for professional ISO 9001 consulting. The audit-readiness tooling is a self-assessment aid; actual certification requires an accredited external audit body.

3. Your account

  • You must provide accurate information when creating your account.
  • You're responsible for keeping your password confidential and for all activity under your account. We strongly recommend enabling two-factor authentication.
  • You may invite others to join your workspace at the roles offered. You're responsible for ensuring those people are authorised to access your business data.
  • You must be at least 18 years old.

4. Your data

You own your workspace data. We act as a custodian only — we don't use your business data to train AI models, sell it, or share it with third parties beyond the sub-processors listed in our Privacy Policy.

You can export your data at any time from the Security page, and delete your account (with a 14-day cooling-off period) from the same page.

5. Acceptable use

You agree NOT to:

  • Use the service for unlawful purposes.
  • Attempt to reverse engineer, exploit, or compromise the service.
  • Upload malware, viruses, or content that infringes others' rights.
  • Resell or sublicense the service without our written consent.
  • Use the service to harass, defame, or harm others.

6. AI-generated content

Compliantly uses Claude (Anthropic) to generate drafts of policies, procedures, suggestions, and analyses. AI-generated content:

  • May contain errors, omissions, or hallucinations and must be reviewed before approval.
  • Is your responsibility once approved — by approving an AI-generated document, you adopt it as your own and warrant its accuracy.
  • Is not a substitute for professional advice from a qualified quality, legal, or compliance practitioner.

7. Subscription, billing, and refunds

Paid plans (when available) are billed in advance, monthly or annually. You may cancel at any time; cancellation takes effect at the end of the current billing period. Annual plans cancelled mid- period are not pro-rata refunded except where required by Australian Consumer Law. Free trials end automatically — we won't bill you without a confirmed payment method.

8. Service availability

We aim for high availability but make no guarantee of uninterrupted service. We may need to perform maintenance with reasonable notice. We are not liable for downtime caused by sub-processors (e.g. AWS, Supabase, Vercel).

9. Warranties & disclaimers

To the extent permitted by Australian Consumer Law: the service is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

Nothing in these terms excludes or limits any consumer guarantees that cannot be excluded under the Competition and Consumer Act 2010 (Cth).

No certification guarantee; no professional advice. Compliantly provides software tools and guidance to help you prepare for ISO 9001 certification. Audit readiness indicators, generated documents, and AI suggestions are preparation aids — they are not a guarantee of certification, and they are not legal, workplace health and safety, or other professional advice. Certification decisions rest solely with your certification body and its auditors. You are responsible for reviewing all generated content and for your own regulatory obligations.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising under or in connection with these terms or your use of the service is limited to the amount you have paid us in the 12 months preceding the event giving rise to liability. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, revenue, data, or goodwill.

11. Indemnity

You agree to indemnify us against claims arising from your misuse of the service, your violation of these terms, or your violation of any third party's rights.

12. Termination

Either party may terminate at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your access ends immediately and your data is scheduled for deletion per our Privacy Policy.

13. Changes to these terms

We may update these terms as the service evolves. Material changes will be communicated via email and a notice in the application. Continued use after changes take effect constitutes acceptance.

14. Governing law

These terms are governed by the laws of Victoria, Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Victoria, except where Australian Consumer Law provides for alternative venues.
